Terms and Conditions
These terms govern the use of the websites, applications and services of Grupo Átila and its group companies (Kelux, Kelux AI Training, Scalor and NotAgency). By using any of our services you accept these terms. If you do not agree, do not use the service.
1. Who we are
The services are provided by Grupo Átila, Rua Mq de Oliveira 6, 2605-152 Queluz, Portugal, and by the group companies identified in each service. Contact: [email protected] and +351 962 066 005.
2. Account and access
- Some services require an account. You must provide accurate information and keep it up to date.
- You are responsible for keeping your credentials secure and for all activity under your account. Tell us immediately if you suspect unauthorised use.
- When you link your account to third-party services such as Google, the terms of those services also apply. You can unlink at any time.
- You must be at least 16 years old to create an account.
3. Acceptable use
When using our services you agree not to:
- Break the law, infringe third-party rights or breach these terms.
- Upload content that is illegal, defamatory, infringes copyright or contains malicious software.
- Attempt to access other users' accounts, systems or data without authorisation.
- Interfere with the operation of the service, overload it or circumvent technical limitations.
- Use the service to send unsolicited communications (spam) or for unlawful surveillance.
- Reverse-engineer, copy or resell the service without written permission.
4. Your content
Content you upload or create remains yours. You grant us a limited licence to host, process and display it only to the extent needed to provide the service. You are responsible for holding the necessary rights to that content.
5. Artificial intelligence features
Some services use artificial intelligence models to generate text, summaries, answers or other output. That output may contain errors or inaccuracies and is not a substitute for professional advice. You should review results before relying on them. We do not use your content to train models without your explicit consent.
6. Intellectual property
The services, software, trademarks, logos and content we make available are the property of Grupo Átila, its group companies or their licensors, and are protected by law. We grant you a personal, limited, non-exclusive and revocable licence to use the service in accordance with these terms.
7. Paid services
Where a service is paid, prices, billing cycle and renewal and cancellation conditions are shown before purchase. Payments made through app stores are subject to the rules of those stores, including their refund policies. Unless stated otherwise, prices include VAT at the applicable legal rate.
8. Availability and changes
We do our best to keep the services available but do not guarantee uninterrupted operation. We may change, suspend or discontinue features, giving reasonable notice where the change is material. We may suspend or close accounts that breach these terms.
9. Warranties and liability
The services are provided "as is". To the extent permitted by law, we are not liable for indirect damages, loss of profit, loss of data or damages resulting from misuse of the service, third-party content or causes beyond our control. Nothing in these terms limits rights granted to consumers by law that cannot be waived.
10. Data protection
The processing of personal data is described in our Privacy Policy, which forms part of these terms.
11. Termination
You may stop using the service and delete your account at any time. We may close your account in case of breach of these terms or prolonged inactivity, with prior notice where possible. Clauses that by their nature should survive (intellectual property, liability, governing law) remain in force after termination.
12. Governing law and jurisdiction
These terms are governed by Portuguese law. The courts of Lisbon have jurisdiction over any dispute, without prejudice to mandatory consumer-protection rules. In the case of a consumer dispute, you may resort to an alternative dispute resolution body; the list is available at www.consumidor.gov.pt.
13. Changes to these terms
We may update these terms. The date of the last update is shown at the top of this page. For material changes, we will notify you through the app or by e-mail. Continuing to use the service after a change means you accept it.
